THE CONSTITUTIONAL COURT’S WHATSAPP DECISION
ANAYASA MAHKEMESİNİN WHATSAPP KARARI

With the decision of the Constitutional Court (the “Court”) dated 28.12.2021 with the application number 2018/34548 published in the Official Gazette on 11.02.2022, the Court ruled that the employer reading the messages of its employee (the “Applicant”) with other workmates through WhatsApp, and the subsequent termination of the Applicant’s employment contract on the grounds of these correspondences are unconstitutional as  these acts violate the right to respect for private life and freedom of communication which are guaranteed by the Constitution of the Turkish Republic (the “Constitution”).

The Applicant’s employment contract was terminated on the grounds that he had correspondence consisting of insulting, slanderous and threatening content with his colleagues within the working hours via WhatsApp on the computer allocated to him. The relevant correspondence was obtained by his supervisor as the Applicant left his computer on. Since the issue was brought in front of it, the Court examined the issue within the framework of “privacy of private life” regulated in article 20 of the Constitution and the “freedom of communication” regulated in article 22.

While examining within the framework of the right to respect for private life and communication rights, the Court drew attention to the positive obligations of the state and stated that the state has the duty to protect all individuals within its jurisdiction against risks that may arise from the actions of public authorities and other individuals, as well as the person himself.

In this regard, the Court stated that the state is obliged not to interfere discretionarily with the private life of individuals and to prevent the unlawful violations of the third parties, confidentiality should be ensured in mutual and collective verbal, written and visual communications of individuals and that unlawful interventions should not be made to communication.

In the decision, the points that should be taken into account regarding the positive obligations of the state were mentioned. These points are as follows:

  • In the disputes arising from the technological opportunities offered by the employer to the employee, a balance should be kept between the employer’s interests and the employee’s fundamental rights and freedoms.
  • It should not be accepted that the employer has unlimited and absolute surveillance and control authority over the technological opportunities provided to the employee.
  • Supervisions and limitations made by the employer on these technological opportunities cannot be of a nature to violate the essence of the fundamental rights of the employees. These actions of the employer must be based on a legitimate aim and the employees must be informed in advance regarding this issue by the employer.

The Court, taking into account the above-mentioned issues, decided that it was a violation of the fundamental rights and freedoms of the employee in terms of the right to respect for private life and the freedom of communication to obtain the correspondence of the employee via WhatsApp by the employer and termination of the employee’s employment contract based on this.

Anayasa Mahkemesi (“AYM”), 11.02.2022 tarihinde Resmî Gazete’de yayımlanan 28.12.2021 tarihli 2018/34548 başvuru numaralı kararı ile çalışanın (“Başvurucu“) WhatsApp sohbet uygulaması üzerinden iş arkadaşlarıyla yaptığı mesajlaşmaların işveren tarafından incelenmesini ve bu yazışmaların gerekçe gösterilerek başvurucunun iş akdinin feshedilmesini, Anayasa ile güvence altına alınmış olan özel hayata saygı hakkını ve haberleşme hürriyetini ihlal ettiği gerekçesiyle Türkiye Cumhuriyeti Anayasasına (“Anayasa”) aykırı bulmuştur.

 

Başvurucunun iş akdi, başvurucunun kendisine tahsis edilen bilgisayardaki WhatsApp adlı uygulama üzerinden iş arkadaşlarıyla görev başındayken hakaret, iftira ve tehdit içerikli yazışmalarda bulunduğu gerekçesiyle feshedilmiştir. Söz konusu yazışmalar, başvurucunun bilgisayarını açık bırakması sonucu amiri tarafından elde edilmiştir. Konu yargıya taşınmış olmakla birlikte AYM konuyu Anayasa’nın 20. maddesinde düzenlenen “özel hayatın gizliliği” ve Anayasa’nın 22. maddesinde düzenlenen “haberleşme hürriyeti” çerçevesinde incelemiştir.

 

Özel hayata saygı hakkı ve haberleşme hürriyeti çerçevesinde inceleme yapılırken AYM devletin pozitif yükümlülüklerine dikkat çekmiş olup, devletin yetki alanındaki bütün bireyleri gerek kamusal makamların ve diğer bireylerin, gerekse kişinin kendi eylemlerinden kaynaklanabilecek risklere karşı koruma yükümlülüğü olduğunu belirtmiştir.

 

Bu bağlamda AYM, devletin kişilerin özel hayatına keyfi olarak müdahale etmemek ve üçüncü kişilerin haksız saldırılarını önlemekle yükümlü olduğunu; haberleşmede, bireylerin karşılıklı ve toplu olarak sözlü, yazılı ve görsel iletişimlerinde gizliliğin sağlanması ve haberleşmeye haksız müdahalelerde bulunulmaması gerektiğini ifade etmiştir.

 

Kararda, devletin pozitif yükümlülüklerine ilişkin olarak dikkat edilmesi gereken hususlara değinilmiştir. Bu hususlar aşağıdaki gibidir:

  • İşverenin çalışanın kullanımına sunduğu teknolojik imkanlar nedeniyle oluşan uyuşmazlıklarda işverenin menfaatleri ile işçinin temel hak ve özgürlükleri arasında bir dengeleme yapılmalıdır.
  • İşverenin işçiye sağladığı teknolojik imkanlar üzerinde sınırsız ve mutlak bir gözetleme ve denetleme yetkisinin olduğu kabul edilmemelidir.
  • İşverenin bu teknolojik imkanlar üzerinde sergilediği denetleme ve sınırlamalar çalışanların temel haklarının özünü zedeleyecek nitelikte olamaz. İşverenin bu eylemlerinin, meşru bir amaca dayanması ve çalışanların bu konuda işveren tarafından önceden bilgilendirilmesi gerekir.

AYM, yukarıda açıklanan hususları göz önünde tutarak, çalışanın WhatsApp uygulaması üzerinden yaptığı yazışmaların işveren tarafından elde edilmesi ve buna dayanılarak çalışanın iş akdinin feshedilmesinin; özel hayata saygı hakkı ve haberleşme hürriyeti bakımından çalışanın temel hak ve özgürlüklerinin ihlali olduğuna karar vermiştir.
