Montreux Convention regarding the Regime of the Straits (the “Convention”), signed in Montreux on July 20th, 1936, is an international convention that authorizes the Republic of Turkey to regulate the full control of the Bosphorus and Dardanelles Strait (the “Straits”) and the passage of the war ships. The Convention regulates the passage regimes while making a distinction regarding the peace and war periods. Accordingly, while the Convention guarantees the free passage of the civil ships through the Straits during peacetime, it limits the passage of the war ships of the countries which do not have a coast to the Black Sea during wartime. Such limitations vary depending on whether Turkey is one of the countries at war. Today the Convention still maintains its importance and some of the significant provisions of the same are as follows:

  • Passage of the Merchant Ships

The passage regime of the merchant ships is regulated between articles 2 and 7 of the Convention.

  • During the peace period, merchant vessels are free to pass through the Straits.
  • During the war period, if Turkey is not one of the countries at war, merchant ships can freely pass the Straits. In case Turkey is one of the countries at war, merchant ships belonging to the countries which are not at war against Turkey, can freely pass the Straits, provided that they do not assist the countries which are at war against Turkey. Furthermore, in the event that Turkey is not at war, but is in imminent danger of war, the merchant ships can pass through the routes determined by the Turkish authorities only during the daytime and guidance may be required for these ships.
  • Passage of the War Ships

The passage regime of the war ships is regulated between articles 8 and 22 of the Convention.

  • During the peace period, the coastal countries of the Black Sea can pass their submarines that they have built or purchased outside the Black Sea through the Straits to join their naval base, provided that Turkey is informed on time. Also, submarines of these countries may pass through the Straits in order to be repaired outside the Black Sea, again provided that Turkey is informed in time. For the both cases, these submarines have to go over the sea during the daytime and pass through the Straits alone.

In order for the war ships to pass through the Straits, prior notification should be made to Turkey. This prior notification period is 8 days for the countries having a coast to the Black Sea and 15 days for the countries which do not have a coast to the Black Sea. Additionally, the Convention foresees detailed restrictions for the foreign war ships that can pass through the States. Besides, war ships of the countries which do not have a coast to the Black Sea cannot stay in the Black Sea for more than 21 days.

 

  • During the war period, if Turkey is not one of the countries at war, war ships can freely pass the Straits in accordance with the regulations regarding the peace period. If there is an aid agreement concluded between Turkey and an attacked country, the war ships of the countries at war cannot pass through the Straits, except for supplying aid. War ships of the countries having a coast to the Black Sea or the war ships which left their ports of registry, belonging to the countries not having a coast, will be able to pass through the Straits in order to reach their own ports. War ships of countries at war are prohibited from attempting to seizure, exercising supervision, and engaging in any hostile action in the Straits. Also, in war period, if Turkey is also at war, Turkey will be able to arrange the passage of war ships at its own discretion. However, in the event of an imminent threat of war, Turkey can implement the passage regime applied during the war time. Nevertheless, if the measure taken by Turkey are found unjustified by the League of Nations (referred today as the “United Nations”), the measures will be cancelled immediately.
  • Passage of the Airplanes

The passage regime of the planes is regulated under article 23 of the Convention.

  • Pursuant to this article, in order to ensure the passage of the civil airplanes between the Mediterranean Sea and the Black Sea, the air routes allocated to this passage, excluding the prohibited areas of the Straits, will be determined by Turkey. Moreover, the civil airplanes can pass through the designated routes by making a prior notification three days before the flight for the non-scheduled flights, and a general prior notification indicating the transition dates for the scheduled flights. Having said that, Turkey will provide the necessary convenience for the safe passage to civil airplanes which are allowed to fly between Europe and Asia, according to the current Turkish aviation management rules.
  • General Provisions

General provisions are regulated under articles 24 and 25 of the Convention.

  • According to the Convention, the control of the Straits has been left unconditionally to Turkey. Furthermore, Turkey has been authorized to enforce the provisions of the Convention regarding the passage regime of the war ships.

20 Temmuz 1936 tarihinde Montrö şehrinde imzalanan Montrö Boğazlar Sözleşmesi (“Sözleşme”), Türkiye Cumhuriyeti devletine İstanbul ve Çanakkale Boğazlarını (“Boğazlar”) tam kontrol ve savaş gemilerinin geçişini düzenleme yetkisini veren uluslararası bir sözleşmedir. Sözleşme, geçiş rejimlerini düzenlerken barış ve savaş dönemi olmak üzere ikili bir ayrım yapmıştır. Bu doğrultuda Sözleşme, barış döneminde sivil gemilerin Boğazlardan serbestçe geçişini garanti altına alırken, savaş döneminde Karadeniz’e kıyısı olmayan ülkelerin savaş gemilerinin geçişini sınırlamaktadır. Bu sınırlamalar Türkiye’nin savaşan ülkelerden biri olup olmamasına bağlı olarak değişkenlik göstermektedir.

 

Boğazların statüsünü ve geçiş rejimini düzenleyen bu Sözleşme günümüzde önemini korumakta olup Sözleşme’nin bazı mühim maddeleri aşağıdaki gibidir:

 

  • Ticari Gemilerin Geçişi

Ticarin gemilerin geçiş rejimi, Sözleşme’nin 2 ve 7. maddeleri arasında düzenlenmiştir.

  • Barış döneminde, ticari gemiler Boğazlardan geçmekte serbesttir.
  • Savaş zamanında Türkiye’nin savaşan ülkelerden biri olmaması halinde ticari gemiler, Türkiye’nin savaşan ülkelerden biri olması halinde ise Türkiye’nin savaşta olmadığı ülkelere ait ticari gemiler, Türkiye’nin savaşta olduğu ülkelere yardımda bulunmamak kaydıyla Boğazlardan serbestçe geçebilecektir. Ayrıca, Türkiye’nin savaşan ülke olmamasına rağmen yakın bir savaş tehlikesi altında olması halinde ticari gemilerin yalnızca gündüz saatlerinde, Türk makamların belirlediği yollardan geçmeleri mümkün olup, bu gemiler için kılavuzluk zorunlu kılınabilecektir.

 

  • Savaş Gemilerinin Geçişi

Savaş gemilerinin geçiş rejimi, Sözleşme’nin 8 ve 22. maddeleri arasında düzenlenmiştir.

  • Barış döneminde, Karadeniz’e kıyıdaş devletler, Karadeniz dışında yaptırdıkları ya da satın aldıkları denizaltılarını Türkiye’ye zamanında haber vermek koşuluyla, deniz üslerine katılmak üzere Boğazlardan geçirebilecektir. İlgili devletler denizaltılarını ayrıca Türkiye’ye zamanında bilgi vermek koşuluyla, Karadeniz dışında onarılmak üzere Boğazlardan geçirilebilecektir. Her iki durumda da bu denizaltıların gündüz vaktinde su üzerinden gitmeleri ve Boğazlardan tek başlarına geçmeleri gerekmektedir.

 

Savaş gemilerinin Boğazlardan geçebilmesi için, diplomasi yoluyla Türkiye’ye ön bildirim yapılmalıdır. Ön bildirim süresi Karadeniz’e kıyısı olan devletler için 8, kıyısı olmayan devletler için ise 15 gündür. Boğazlar’an geçiş yapabilecek olan yabancı deniz kuvvetlerinin toplam tonajı için üst limit 15.000 ton ile sınırlıdır. Karadeniz’in en güçlü donanmasının tonajının, Sözleşmenin imzalandığı tarihte Karadeniz’deki en güçlü donanmanın tonajını en az 10.000 ton geçmesi halinde, Karadeniz’e kıyısı bulunan diğer ülkeler Karadeniz donanmalarının tonajlarını en fazla 45.000 ton arttırabilecektir. Karadeniz’e kıyısı olan ülkeler, her yıl 1 Ocak ve 1 Temmuz tarihlerinde Karadeniz donanmasının toplam tonajını Türkiye’ye bildirmelidir. Ayrıca, Karadeniz’e kıyısı bulunmayan devletlerin Karadeniz’e, insancıl niyetle göndereceği deniz kuvvetlerinin toplamı 8.000 tonu geçemez. Bununla birlikte, Karadeniz’e kıyısı bulunmayan ülkelerin savaş gemileri 21 günden uzun bir süre Karadeniz’de kalamayacaktır.

 

 

 

  • Savaş döneminde ise, Türkiye savaşan ülkelerden biri değilse, barış dönemine ilişkin düzenlemeler ışığında, savaş gemileri Boğazlara ulaşım özgürlüğünden yararlanır. Eğer saldırıya uğrayan bir ülke ile Türkiye arasında akdedilen bir yardım antlaşması bulunuyorsa, yardım haricinde savaşan ülkelerin savaş gemilerinin Boğazlardan geçmesi mümkün olmayacaktır. Karadeniz’e kıyısı bulunan veya kıyısı bulunmayan ülkelerin bağlama limanlarından ayrılmış olan savaş gemileri, kendi limanlarına ulaşmak amacıyla Boğazlardan geçebilecektir. Savaşan ülkelerin savaş gemilerine Boğazlarda el koyma girişiminde bulunmaları, denetleme yetkisi uygulamaları ve düşmanca bir eylemde bulunmaları yasaklanmıştır. Ayrıca, savaş zamanında, Türkiye savaşan ülke ise, savaş gemilerinin geçişini dilediği gibi düzenleyebilecektir. Bununla beraber, yakın bir savaş tehlikesi halinde, Türkiye savaş halinde olduğu geçiş rejimini uygulayacaktır. Ancak bu doğrultuda, Türkiye tarafından alınan önlemler Milletler Cemiyeti (“Milletler Cemiyeti” ya da günümüz adıyla “Birleşmiş Milletler”) tarafından haksız bulunursa, önlemler derhal kaldırılacaktır.

 

  • Uçakların Geçişi

Uçakların geçiş rejimi Sözleşme’nin 23. maddesinde düzenlenmiştir.

  • Bu madde uyarınca, sivil uçakların Akdeniz ile Karadeniz arasında geçişinin sağlanması için, Boğazların yasak bölgeleri hariç olmak üzere, bu geçişe ayrılan hava yolları Türkiye tarafından belirlenecektir. Ayrıca sivil uçakların, tarifesiz uçuşlar için uçuşun üç gün öncesinden, tarifeli uçuşlar için ise geçiş tarihlerini belirten genel bir ön bildirim yaparak belirlenen yollardan geçmesi mümkündür. Bununla birlikte, Türkiye yürürlükteki Türk hava ulaşımı yönetim kurallarına göre, Avrupa ile Asya arasında Türkiye üzerinden uçuşlarına izin verilen sivil uçaklara, güvenli geçiş için gereken kolaylığı tanıyacaktır.

 

  • Genel Hükümler

Genel hükümler Sözleşmenin 24. ve 25. maddelerinde düzenlenmiştir.

  • Sözleşme uyarınca Boğazların kontrolü kayıtsız şartsız Türkiye Cumhuriyeti’ne bırakılmıştır. Buna ilaveten Türkiye, Sözleşmenin savaş gemilerinin Boğazlardan geçiş rejimine dair hükümlerinin yürütülmesi konusunda sorumlu kılınmıştır.
