As vaccinations continue within the scope of fighting against the COVID-19 pandemic, the General Letter (“General Letter”) dated 02.09.2021 including information on PCR test that employers will require from their employees and the employers’ obligation to notify their employees on the risks and precautions of COVID-19, was served to the Governorships all around the Turkey by the T.R. Ministry of Labor and Social Security (“Ministry”).

In accordance with the General Letter, it is reminded to the employers of their obligation to inform all their employees regarding the protective and preventive measures on the health and safety risks that may be encountered in the workplace, and furthermore employers are also requested to inform their employees, whose COVID-19 vaccines have not been completed, in writing.  Accordingly, it has been also set forth that the possible consequences of the definitive diagnosis of COVID-19  in terms of labor and social security legislation should be reported to the unvaccinated employees.

It should be emphasized that pursuant to the General Letter, employees who have not been vaccinated against COVID-19 may be required by the employer/workplace to have a PCR test once a week mandatorily, as of September 6, 2021 and the test results will be kept in the workplace for necessary actions to be taken.

COVID-19 pandemisi ile mücadele kapsamında aşılama süreci devam ederken, işverenlerin işçilerinden isteyeceği PCR testi ve işçilerini COVID-19 riskleri ve tedbirleri konusunda bilgilendirmesini içeren 02.09.2021 tarihli Genel Yazı (“Genel Yazı”) T.C. Çalışma ve Sosyal Güvenlik Bakanlığı (“Bakanlık”) tarafından 81 İl Valiliği’ne gönderilmiştir.

İlgili Genel Yazı uyarınca, işverenlerin işyerinde karşılaşılabilecek sağlık ve güvenlik risklerine yönelik koruyucu ve önleyici tedbirler hakkında tüm işçilerini bilgilendirme yükümlülüğü hatırlatılmakta olup, işverenlerin COVID-19 aşısı tamamlanmamış işçilerini yazılı olarak ayrıca bilgilendirmesi de talep edilmektedir. Bu doğrultuda, aşı olmayan işçilere kesin COVID-19 tanısı konması durumunun iş ve sosyal güvenlik mevzuatı açısından olası sonuçlarının da ilgili işçilere bildirilmesi gerektiği düzenlenmiştir.

Önemle belirtilmelidir ki Genel Yazı doğrultusunda, COVID-19 aşısı olmayan işçilerden 6 Eylül 2021 tarihi itibariyle zorunlu olarak haftada bir kez PCR testi yaptırmaları işveren/işyeri tarafından istenebilecek ve test sonuçları gerekli işlemler yapılmak üzere işyerinde kayıt altında tutulacaktır.
